Terms of Service
The terms that govern use of the FYC Solutions website and services.
Last updated: 09/10/2026
1. Services overview
FYC Solutions provides template-based website builds and optional hosting or maintenance services. Deliverables, timelines, and pricing are agreed in writing before work begins.
2. Template-only scope
Unless agreed in writing:
- Services are template-based and fixed scope
- We do not provide custom software development
- Additional requests outside the agreed scope may require a separate agreement, timeline, and fee
3. Client responsibilities
You agree to:
- Provide accurate information and timely feedback
- Ensure you have the rights to any content you provide (logos, photos, text, trademarks)
- Confirm that any claims on your website are truthful and compliant with applicable laws (including advertising rules)
You are responsible for the legality and accuracy of your website content.
4. Revisions and approvals
Unless agreed in writing, projects include a limited revision process. Once the final version is approved, or if feedback is not provided within a reasonable time, the project may be considered complete.
5. Payment and draft approval
For one-time website builds, we prepare a first draft based on your selected template and the content you provide. If you do not approve that draft, you do not pay for the build — you simply tell us in writing that you are not proceeding, and no build fee is owed.
This applies to the initial draft only. Once you approve a draft, the build fee becomes payable and is non-refundable. Approval may be given in writing or by asking us to publish the site. The no-payment option does not apply to monthly maintenance plans, out-of-scope work agreed separately, or third-party costs such as domains, email, or paid services purchased on your behalf.
6. Hosting and maintenance
If hosting or maintenance is purchased, the support scope, response times, and limits will be defined in writing or on the Maintenance Scope page. Third-party platforms may change or experience outages outside our control, so uninterrupted service is not guaranteed.
7. Third-party services
Your website may rely on third-party services such as domain registrars, website platforms, forms, or embedded tools. Those services may have their own terms and privacy policies.
8. No professional advice
We may provide general guidance about websites and online presence, but we do not provide legal, tax, or financial advice.
9. Disclaimer
The website and services are provided “as is” and “as available.” We do not guarantee specific business outcomes, including rankings, leads, or revenue.
10. Limitation of liability
To the fullest extent permitted by law, FYC Solutions is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for a service-related claim will not exceed the amount paid for the services giving rise to that claim.
11. Indemnification
You agree to defend and indemnify FYC Solutions against claims arising from content you provide, your business practices or representations, or violations of law or third-party rights.
12. Termination
Either party may terminate services as agreed in writing. Completed work and fees incurred before termination remain payable as applicable.
13. Governing law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
